Following the Bundestag, the Bundesrat also approved the Unified Patent Court Agreement Act with the required two-thirds majority on December 18, 2020.
The treaty law can now be forwarded to the President for signature and then be published in the Federal Law Gazette. With the ratification by the Federal Republic of Germany, the requirements for the entry into force of the Unified Patent Court Agreement – on the first day of the fourth month after the deposit of the German instrument of ratification – are then also fulfilled. It can enter into force when it has been ratified by thirteen member states, including the three with the most European patents in force, which includes Germany.
